General Terms & Conditions

1. Introduction
These General Terms and Conditions (hereinafter referred to as the "Terms") apply to your engagement with and use of the services provided by Verbalife (Pty) Ltd, a company registered in South Africa under registration number 2016/028758/07, and also registered in France as a foreign firm under SIRET number 88358256100014, operating under the name Real Estate Results (hereinafter referred to as "Real Estate Results," "our," "we," or "us") and the services provided by Real Estate Results (hereinafter referred to as the "Services"). By using Real Estate Results or the Services, you acknowledge and agree to these Terms. If you do not accept these Terms, you must not use Real Estate Results or the Services.

2. Services

Real Estate Results offers a real estate solution that connects property sellers or property buyers with our client (hereinafter referred to as the "Client"). The Services include the creation of highly intelligent real estate campaigns(hereinafter referred to as the "Campaigns"), with the aim of connecting the Client with property sellers or property buyers, depending on the particular Campaigns in question. We reserve the right to modify or discontinue the Services at any time without prior notice.

3. Payment

Our Services are on-demand, and payment is required in advance. We commence the creation of Campaigns upon receipt of a signed purchase order, but Campaigns can only be launched after payment is received. Since our team begins working immediately upon order confirmation, any cancellation (which must be submitted in writing) will result in cancellation fees: 0% (for cancellations within 3 days), 25% (for cancellations after 3 days), and 50% (for cancellations after 7 days) of the order amount. The full cancellation fee is due within one week of the invoice issuance date by Real Estate Results to the Client.

4. User Accounts

To use the Services, we must create a user account for you (hereinafter referred to as the "Account"). You are responsible for maintaining the confidentiality of your Account and all activities occurring under it. You agree to notify us immediately of any unauthorized use of your Account.

5. User Content

You are solely responsible for the information, data, text, software, music, sound, photographs, graphics, videos, messages, or other materials (hereinafter referred to as "Content") that you upload, post, or transmit via Real Estate Results. You agree not to upload, post, or transmit any Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or otherwise objectionable based on race, ethnicity, or other grounds. You also agree not to upload, post, or transmit any Content that infringes on patents, trademarks, trade secrets, copyrights, or any other proprietary rights of a third party.

6. User Conduct

You agree to use Real Estate Results and the Services only for lawful purposes. You agree not to take any actions that may compromise the security of Real Estate Results or harm other users. You also agree not to use Real Estate Results or the Services to send unsolicited commercial communications or to harvest or collect personal information from other users.

7. Intellectual Property

The Services, including all Content and materials contained in Real Estate Results, such as but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, are the property of Real Estate Results and are protected by South African and international copyright and trademark laws.

8. Disclaimer of Warranties

Real Estate Results and the Services are provided "as is" and "as available." We make no representations or warranties of any kind, express or implied, regarding the operation of Real Estate Results or the Services or the information, Content, materials, or products included with Real Estate Results.

9. Limitation of Liability

Under no circumstances shall Real Estate Results be liable for any damages, including but not limited to direct, indirect, special, incidental, or consequential damages, arising from or related to the use or inability to use Real Estate Results or the Services.

10. Indemnification

You agree to indemnify and hold harmless Real Estate Results and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your use of Real Estate Results or the Services, your violation of these Terms, or your infringement of another person's rights.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to conflict of law principles.
